Fees

Client agrees to pay a retainer fee of $50 at the time of booking to secure their session. This is a non-refundable retainer fee that goes toward the session. The balance is due at the time of the session. The session fee covers the time and talent of photographer, retouching and creative editing of images, as determined by the photographer, and the number of edited digital images guaranteed in your package. Package inclusions can be found at www.elisewelker.com/pricing. Additional digital images may be included or available for purchase at the discretion of the photographer. Raw, original image files are not distributed.

rescheduling-regular family & newborn sessions

If a situation prevents a session from taking place, client may reschedule their regular portrait session with at least 24 hours notice and their deposit will be applied to a future date. In the case of child illness, photographer understands that 24 hours may not always be possible. Client will strive to provide as much notice as possible in those instances. If a client does not arrive for their session, the deposit will be forfeited. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond control.

rescheduling-Outdoor Mini Sessions

Booking a mini session is like purchasing a ticket to an event. Be sure to hold on your calendar both the session date and, for outdoor sessions, the rain date as well. If a client is unable to attend their scheduled mini session for any reason, it is understood that the $50 retainer fee will not be refunded, as it will cover the time slot that was reserved just for your family/child, and communication/planning time for your session. The balance of the session will be refunded, as that covers image editing time. The retainer cannot be applied to a future mini session, due to the nature of these sessions being special dates when sessions are booked back-to-back with another.

session start times

Client understands that their session begins at the scheduled time, and in many cases an extension of time is not possible if client is late. Clients are encouraged to arrive for their session 5-15 minutes early depending on the parking situation and amount of time needed to walk to the meeting location, including the studio.

Copyright

The photographs produced by the photographer are protected by Federal Copyright Law (all rights reserved). The photographer grants the client permission to print the images for personal use and to share the images on social networking websites, with family and friends and on personal websites as long as credit is given to the photographer. The client must obtain permission from the photographer for other uses such as professional publication or commercial usage.

Model Release

The photographer has the unrestricted right to use and publish photographs of the client and client’s minor child(ren) for editorial, advertising, educational and other marketing purposes, including but not limited to social networking websites and the photographer’s online portfolio. The client releases all claim to profits that may arise from use of the images.

Limit of Liability

In the unlikely event that the photographer is unable to perform to the terms of this contract due to an injury, illness, weather event, act of terrorism or other cause beyond the photographer’s control, liability is limited to the return of all payments received from the client. In the unlikely event that digital files have been lost, stolen or destroyed beyond the photographer’s control, including hard drive or equipment malfunction, the photographer will offer to re-shoot the session at no additional cost to the client, or return all payments received.

Safety

Client will not hold the photographer, or the owner of any private property used as a location, liable for any injury that may occur during a session. Both photographer and client enter session locations at their own risk. Client is responsible for the safety of their children. The photographer cannot control the presence of animals in nature, including snakes and ticks.

skin editing

Client understands that basic skin smoothing and retouching are complimentary and included in the package. If extensive editing is requested an additional fee may apply. The definition of extensive is at the discretion of the photographer.

file delivery

Upon delivery of the digital images, client understand that they are responsible for the originals and all copies of their files, documents, digital images, photographs, albums or other products and Elise Welker Photography may not be able to reproduce or replace any such files, documents, digital images, photographs, or other products that are lost, stolen or destroyed. Creating a second back-up copy of digital files is highly recommended. Client must have a computer that is capable of downloading and storing large image files. In the event that client does not have file storage space, a flash drive of images is available for purchase.

satisfaction

Client understands that children, hair, skin and clothing can be unpredictable at times, and satisfaction with these elements can’t be guaranteed by anyone.
